1. Introduction. These Terms & Conditions (the “Agreement”) govern your enrolment in driver training (in-car lessons, classroom lessons, packages, etc.) provided by Ez2Drive Academy (“we”, “us”, “our”). By enrolling, paying for, or participating in training you accept and agree to these terms. 2. Services Provided a) We provide driver training services including in-car instruction, road-test prep, package offers, etc. b) All services are provided under the license and regulatory obligations of the Insurance Corporation of British Columbia (“ICBC”) for driver-training schools in BC. ICBC Business Partners+2BC Laws+2 c) You agree to follow all instructions from your instructor, comply with applicable laws/regulations (e.g., the Motor Vehicle Act Regulations) in British Columbia. Eligibility & License Requirements a) Prior to in-car lessons you must hold the required valid British Columbia licence/learner permit (e.g., Class 7L or 7N) or otherwise as required by your package. b) You must bring your licence/permit to each lesson. If you fail to do so, we reserve the right to cancel the lesson and charge/forfeit a cancellation fee. c) If you are under the legal age or otherwise not eligible under applicable law or ICBC-approved training requirements, we may refuse service. 4. Booking, Rescheduling & Cancellation a) Lessons are booked in advance via our scheduling system (phone/email/portal). b) To cancel or reschedule a lesson you must give at least 24 hours’ notice. Failure may result in a cancellation fee as detailed in our website or forfeiture of the lesson. c) If we cancel or delay a lesson (for example instructor unavailability, vehicle issues, severe weather) we will notify you and reschedule as soon as reasonably possible or offer a refund/credit. 5. Payment & Refunds a) Payment is due at enrolment or as otherwise stated in your package. b) All fees are in Canadian dollars (CAD) and GST applies where applicable. c) Unless stated otherwise, lesson packages expire 12 months after purchase if unused. d) Refunds: If you cancel training before it commences, with more than 24 hours notice you may be eligible for a partial or full refund less administration fees. Once training has commenced or you have utilised lessons, no refunds will be offered except at our sole discretion. e) Road-test booking fees, special packages, third-party costs may not be refundable. 6. Conduct & Responsibilities a) You must arrive on time, suitably attired (closed-toe shoes, no distractions), with your license/permit, and mentally and physically fit to drive. b) Use of mobile phones, texting, intoxicated driving, or other unsafe behaviors during instruction is strictly prohibited. c) You must follow your instructor’s directions and the rules of the road; failure may lead to termination of the lesson or your enrolment without refund. d) You agree to treat staff, instructors, vehicles, and other students with respect; misconduct may lead to termination. 7. Vehicles & Equipment a) We provide vehicles that meet regulatory and safety requirements and our internal standards. b) You are responsible for any damage caused deliberately or negligently to the vehicle during your lesson, subject to the limits stated in your enrolment agreement. c) You must inspect the vehicle at the start of the lesson and immediately advise your instructor of any pre-existing damage. 8. Road Test Booking & ICBC Requirements a) If our package includes road-test booking, you must meet all eligibility criteria and follow the booking policies of ICBC and our school. ICBC Business Partners+1 b) You are responsible for being ready (licence/permit, fees, arrival) on the day of the test; missed bookings or late cancellations may incur ICBC and/or school fees which you will be liable for. 9. Limitation of Liability and Waiver a) While we aim to provide safe and professional instruction, you acknowledge that driving carries inherent risks, and you agree to release us, our instructors, agents, employees, from any liability for personal injury, property damage, or indirect losses except where caused by our gross negligence or wilful misconduct. b) Our total liability for any claim arising out of or in connection with the training is limited to the amount of fees you paid for the specific service giving rise to the claim. 10. Termination a) We may terminate or suspend your enrollment (with or without refund) if you breach these Terms, display unsafe or unacceptable conduct, fail to meet license/permit requirements, or as required by law/regulator. b) You may withdraw from training at any time by giving written notice; refund eligibility will depend on unused lessons and our refund policy (see Section 5). 11. Intellectual Property All course materials, manuals, slide decks, or digital content remain our copyright. You may not reproduce, distribute, or resell them without our prior written consent. 12. Privacy & Data Use We collect your personal information (license/permit details, contact info, lesson history, etc.) to deliver training, comply with regulatory obligations (e.g., ICBC’s record-keeping) and for internal administration. Your personal information will be handled in accordance with our Privacy Policy (see Section 13 below and the separate Privacy Policy document). By enrolling you consent to our collection, use and disclosure as described. Our Privacy Policy provides further details. 13. Changes to Terms We may update these Terms & Conditions from time to time. We will publish the updated terms on our website and notify you if significant changes are made. Continued participation after changes constitutes acceptance. 14. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
